Executive Pardon Power Needs to Be Restricted (ContributorNetwork)

COMMENTARY | Over the years, executive pardons have generated controversies at state and federal levels. The recent public outrage over Mississippi Gov. Haley Barbour's decision to pardon several convicted killers again brings attention to the abusive nature of pardon powers. Before this controversy, there were serious questions regarding clemencies granted by former presidents Bill Clinton and George W. Bush. Should there be limits to this executive power?

The original intent of pardon power was to prevent miscarriages of justice. If a person was wrongly convicted or harshly sentenced, the president or governor will be able to correct the injustice. Unfortunately, many of the recent pardons drift from the law's true spirit. The clemencies recently granted by Barbour are perfect examples of this abuse.

In the case of the four convicted killers pardoned by the governor, there were never any reservations regarding the original convictions. Furthermore, popular support for these pardons is almost nonexistent. Barbour can't really claim he made these decisions for the public good.

The worst part about these pardons was the fact Barbour did not consult with or notify the families of the victims prior to making this decision. In an interview with Fox News, the governor defended his decision citing Christian values of forgiveness and compassion. Yet, he showed arrogance and insensitivity to the victims' families in his handling of the situation.

As the U.S. is a democracy, the idea one person holds the power to pardon any convicted criminal runs contrary to core democratic tenets. If jurors and not judges are tasked with deciding the fate of a defendant in court, why couldn't the legislative branch or the public have some say on pardoning decisions?

Since there are some merits to executive pardon powers, they should not be completely eliminated. But changes should be made to hold executive chiefs accountable for their pardons and commutations. Given that presidential pardon power is keenly protected by the U.S. constitution, any changes will have to take place at the state level. Hopefully, the recent controversy has raised enough public awareness on this important issue to empower corrective actions.

Surprise! People like free stuff, Amazon's lending library a success

You can always count on people's desire to avoid paying for stuff. That's why it shouldn't come as any surprise that Amazon's Lending Library is such a success. The free perk available to Prime customers who also happen to be Kindle owners launched in November with just 5,000 books available. Since then the library has expanded to over 75,000 titles with over 295,000 people borrowing an independently published KDP e-tome in December alone. To celebrate Amazon is adding another $200,000 to the pool available to Direct Publishing authors, pushing the grand total to $700,000. Third survivor found on stricken cruise ship

The U.S. Embassy in Rome issues a statement revising the number of Americans estimated on board the Costa Concordia to 125 from 126.

Reuters reports that teams are painstakingly checking thousands of rooms on the Costa Concordia for the nearly 40 people still missing after the huge vessels foundered and keeled over with more than 4,000 n board, killing at least three and injuring 70.

The task is akin to searching a small town - but one tilted on its side, and largely in darkness and submerged in freezing water. Scores of divers were taking part.

Just after dawn on Sunday, a team made voice contact with a third survivor still on board the ship. "We are doing the impossible to reach this person," coastguard spokesman Luciano Nicastro told Italian television.

After midnight, rescue workers had found the two South Koreans still alive in a cabin, after locating them from several decks above, and brought them ashore, looking dazed but unharmed.

The captain of the luxury 114,500-tonne ship, Francesco Schettino, was under arrest and accused of multiple manslaughter, causing a shipwreck and abandoning ship, Italian police said.

Sky News is reporting that a rescue team has placed a third survivor on a stretcher and are in the process of removing him from the ship.

?A third survivor was located inside the overturned Costa Concordia cruise ship off the western coast of Italy, a spokesman for Italian firefighters told The Associated Press on Sunday.

Rescuers had spoken to the person inside the ship but the survivor had not yet been removed, Luca Cari told the AP.

Rescue crews circling the wreckage of a cruise ship that ran aground off the Tuscan coast have heard sounds from within the ship, Britain's Sky News reported on Sunday.

Sources said that fire department crews had heard sounds from deck 3, Sky reported. A few dozen people remained unaccounted for.

Crews in dinghies were seen Sunday morning touching the hull with their hands. They were near the site of the 160-foot-long gash where water flooded in and caused the ship to fall on its side.

Coast guard officials have said divers will try to enter the belly of the ship in case anyone is still inside Italian news reports quoting local officials say some 40 people remain unaccounted for out of the 4,200 passengers and crew. Three people are confirmed dead.

Google's Matias Duarte reveals design standards for Android 4.0 at CES 2012

Looking for a little more consistent UI experience with your Android devices? Google is looking to make that happen as the folks in Mountain View has revealed that the upcoming Ice Cream Sandwich OS will be the first Android software to institute design standards for developers. Android Design is a online repository for the UI guidelines and blueprints for version 4.0, which we learned would unify smartphones and tablets back at Google I/O. This set of information should make things all neat and tidy for ICS devices, keeping user interface characteristics a bit more cohesive from app to app. Here, devs will find all the basic info and elements that are native to platform in order to make the best applications possible for the OS. Mr. Duarte warns that if you choose to not follow the style guide, your software will stand out -- and not in a good way. He also quipped that these are indeed guidelines, not mandates. And that they will gain value as more folks adopt them. Yeah, we know... the competition from Cupertino has been doing this for a while now, but a bit more structure in the Android universe certainly won't draw any complaints from us.

eBay Forecasts $8B In Mobile Commerce Volume In 2012; PayPal Will Reach $7B

ebayAt his CES keynote yesterday evening, eBay CEO (and new interim PayPal CEO) John Donahoe revealed a number of new mobile payments forecasts for both eBay and PayPal. As we heard from PayPal VP David Marcus a few days ago, PayPal surpassed its expectation of $3.5 billion in mobile payments in 2011, reaching $4 billion for the year. Donahoe said in his keynote that eBay reached $5 billion in mobile GMV (gross merchandise volume) in 2011, doubling 2010's GMV. He also projected yesterday that eBay would reach $8 billion in mobile GMV in 2012, and PayPal will reach $7 billion in transactions in 2012. eBay Mobile currently has more than 65 million downloads of eBay?s mobile applications across platforms. And more than 890,000 new eBay shoppers made their first eBay purchase through the company?s mobile apps in 2011, a 113% increase year over year.

UFC 142: Mike Pyle is fired up to fight in front of hostile crowd

Mike Pyle has fought all over the world, but even he admits tomorrow night at UFC 142, Rio de Janeiro could be unlike anything he's ever seen.

"We're fighting and we have to fight other countryman on their soil. That makes it fun. Get out there in some hostile territory," Pyle told ESPN1100/98.9 FM. "It's kind of different. You don't get booed and looked at in strange ways at home. It's cool. Makes me feel like a super villain."

Pyle won't be walking through the Rio crowd with complete unfamiliarity. He cornerd Forrest Griffin back at UFC 134 and saw how intense the Brazilians were that night.

"The energy was ... I just got chill bumps just now thinking about that night when we walked out, how intense the crowd was," Pyle said. "They were into it dude. I can't even put it into words. It was awesome."

Pyle, 36, has fought in Denmark, Russia and the U.K. This will be his first time in Brazil and he's facing Bahia, Brazil native Ricardo Funch. The American is coming off a quick loss against Rory MacDonald. He made sure to make some changes to get back on the right track.

Pyle added a new jiu-jitsu coach, Mitch Coats and Nate Pettit, who's serving as his main coach.
