Neighbors help out in Tennessee tornado recovery

HARRISON, Tenn. (AP) - The communities of Harrison and Ooltewah are still scarred with uprooted, twisted trees and homes under construction after a March 2 tornado, but neighbors are helping each other on the path to recovery.

The EF3 tornado destroyed 82 homes and damaged 262 more. But even as bulldozers and roofers repair the damage, not everyone has been able to recover as quickly, The Chattanooga Times Free Press reports (http://bit.ly/V55SE7 ).

Carl Evett lost his small uninsured home in the tornado, and while many insured homeowners have been able to rebuild, he's been struggling.

So during this holiday season, his neighbors partnered with volunteers from the Bayside Baptist Church to use donated materials and the money he received from the Federal Emergency Management Agency to build a new home.

Bills fire Gailey after 3 straight losing seasons

(AP) ? Chan Gailey didn't work out after three losing seasons, leaving the Buffalo Bills looking for their fifth head coach since 2001.

The Bills fired Gailey on Monday after he failed to deliver on his vow to transform a losing franchise into a playoff contender. Gailey's entire staff was fired, too, but the status of general manager Buddy Nix remained uncertain, and could be decided as early as Tuesday.

Bills CEO Russ Brandon returned to Buffalo on Monday night after spending the day meeting with team owner Ralph Wilson at his home outside Detroit. Nix did not make the trip, and instead stayed at the team's facility.

The Bills have made tentative plans to have a team official address the media Tuesday.

The decision to fire Gailey was announced shortly after Brandon arrived in Detroit.

Gailey's teams lost twice as many games as they won, going 16-32 over three seasons. The Bills have now posted eight straight losing seasons, and closed with a second straight 6-10 mark after beating the New York Jets 28-9 on Sunday.

"I understand this is a business," said Gailey, who had at least one year left on his contract. "We didn't get the job done."

Gailey spoke for a little over a minute. He declined to take questions, while growing emotional at one point. Among the assistants fired were assistant head coach and defensive coordinator Dave Wannstedt.

"I've been called two other times to get things turned around, was able to do it," Gailey said, referring to previous stops with Dallas (1998-99) and Georgia Tech (2002-07). "We weren't able to get this one done soon enough, and I understand that completely."

It was a disappointing finish for a team that had much higher aspirations. The Bills spent much of the past 14 months securing their top players, re-signing receiver Stevie Johnson and quarterback Ryan Fitzpatrick to lucrative multiyear contracts.

The spending spree reached its peak in March, when they signed defensive end Mario Williams to a six-year, $100 million contract.

"It's always disappointing," said defensive tackle Kyle Williams, one of the only players left in the locker room when the team announced Gailey's firing.

What frustrates Williams more is how the Bills keep making changes without getting any results.

"I get tired of losing," Williams said. "More than anything, I get tired of putting in tons and tons of work. And it's hard sitting here talking to you guys at the end of December feeling like another one kind of slipped through your fingers."

What's next remains unclear.

Nix was not available Monday, and canceled his weekly radio show on Friday.

Gailey's dismissal is a significant setback for Nix. The general manager announced in November that Gailey wasn't going anywhere, because another coaching change would stunt the team's development.

The Bills, however, closed by losing seven of their final 10 games.

Wilson had initially backed Nix's build-through-the-draft approach. Three years ago, the 94-year-old owner said he expected the rebuilding process could take as long as five years.

Brandon has been unhappy with the criticism leveled at the Bills, and how it's translated into poor ticket sales. Buffalo failed to sell out its three of its final four home games. And the fourth, against St. Louis on Dec. 9, wasn't a sellout until a local restaurateur purchased the remaining 10,000 tickets.

One option is for the Bills to make a splash in hiring their next head coach, as they attempted in their previous search.

After firing Dick Jauron in November 2009, Wilson expressed a desire to open his checkbook to lure a high-profile coach to Buffalo only to be rebuffed by Mike Shanahan, who instead landed in Washington.

The most high-profile candidates available include coach-turned-broadcaster Jon Gruden and Andy Reid, who was fired by Philadelphia on Monday. Then there's two candidates in the college ranks, Oregon's Chip Kelly and Penn State's Bill O'Brien, who had numerous friends and former colleagues on Gailey's staff.

An offensive specialist, Gailey was unable to spark the Bills popgun attack under Fitzpatrick. The Bills finished 19th in the NFL in yards gained and 21st in points this season. Gailey was faulted for under-utilizing the offense's most dynamic threat, running back C.J. Spiller.

"It's sickening," running back Fred Jackson said, referring to how the Bills failed to play up to expectations. "As players, we had the highest hopes out of everybody. And for us to fall short of that, we don't like it at all. It's depressing."

Ultimately, it was the Bills' porous defense that doomed Gailey.

The Bills allowed 400-plus points in each of the past three seasons, including 435 this year ? the second-most in team history. Though Williams' presence improved the pass rush, Buffalo became the NFL's eighth team, and first since the 1986 Jets, to allow 45 points four times in one season.

Fitzpatrick's status is uncertain in part because he's due a $3 million bonus in March. He went 16-29 since taking the starting job three games into the 2010 season.

Fitzpatrick declined to speculate on his future. After speaking to reporters, Fitzpatrick hugged Johnson, and the two left with the receiver's arm over the quarterback's shoulder.

Reading from notes he jotted on a Bills pad, Gailey's eyes welled with tears when he credited Bills fans for their loyalty, and Buffalo for being a passionate football city.

"I think that the next staff will have a great opportunity for success, and make this another great football franchise," Gailey said. "This will probably be, and I say probably, but I think it will be the first place that's ever fired me that I'll pull for."

York's director of economic and community development could replace DePasquale

Other people interested in the Democratic nomination for the state House seat withdrew their name from consideration, according to the local party.

Kevin Schreiber, York's director of economic and community development, could be the Democratic candidate to replace state Rep. Eugene DePasquale, D-West Manchester Township.

DePasquale will vacate his state House seat when he is sworn in as state auditor general on Jan. 15, according to Liz Wagenseller, his spokeswoman.

In November, the York County Democratic Party began formally taking letters of intent from people interested in replacing DePasquale. The application deadline was Dec. 21.

Several people expressed interest in the position, but withdrew their names from consideration when they learned Schreiber was seeking the position, according to a news release from the local party.

"I want to thank everyone for their affirmation and insight," Schreiber said in the news release. "Eugene DePasquale has done an excellent job representing our District, and I would be honored to serve, following in his footsteps."

The news release described Schreiber as the "potential candidate" for the 95th Legislative District, which includes York, West York, North York, Spring Garden Township and part of West Manchester Township. Schreiber will take part in a public forum on Jan. 8.

The news release states that following the forum and DePasquale's resignation from the state House, a nomination recommendation committee will convene to make to make a formal recommendation to the Pennsylvania Democratic Party's executive committee.

Bob Kefauver, chairman of the York County Democratic Party, said Schreiber "would be an exceptional candidate."

"He is heavily involved in the community and is well respected by his peers and colleagues," Kefauver said in the news release.

The speaker of the state House will set a date for a special election after DePasquale resigns from the House.

York County Democratic Party officials have previously said they want that special election to take place the same day as the May primary, because it would be the most cost-effective option.

Bob Wilson, chairman of the York County Republican Committee, is advocating for an earlier date, saying that a May election is too long for residents of the 95th Legislative District to go without representation in the state House.

The GOP

The York County Republican Committee is still taking nominations, said chairman Bob Wilson. He said they've received a few letters of intent.

Members of the local committee who live in the 95th Legislative District will decide on their GOP candidate. And Wilson said he anticipates a transparent and public interview process.

Google Play Surges, Apple App Store Still Lords Over Mobile App Market

Google-PlayGoogle Play recorded a big surge in its sales of mobile applications but it is still Apple?s App Store that reigned supreme after garnering the largest share in the pie, Mobile analytics Distimo released Wednesday.

Google Play has been on a tear in the mobile app market over the last four months, recording a 43 percent jump in its daily sales across 20 countries as reported by Distimo.

Then again, the figure was not enough to topple the App store from its thrown as Apple?s app distributor also registered a decent surge in its sales after gaining a 21 percent increase on a daily basis.

The App store also benefited from its strong performance in the first months of 2012, especially in January when it chalked up 51 percent on daily sales.

Destimo pointed out that the decline of App Store?s sales is caused by an already higher revenues, leaving Apple with limited room to generate more money. A good example for this is the Apple?s huge sales November, when it surpassed the $15 million threshold while Google Play only registered $3.5 million across 20 countries.

According to Destimo, the United States was the biggest market for Apple?s App store in 2012, while Japan, the United Kingdom, and Australia rounded up the Big 4. On the other hand, the United States and Japan are the largest markets for Google Play while Android-heavy using country Korea ranked third.

Naver?s Line Pop is the most successful game on any app store recently, recording 1.75 downloads three days from its release. It already racked up a cool $1 million in sales within its first 12 days.

However, the mobile app market is not always a mine of gold as an influx of new applications continued to crowd the market daily, hurting in the process start-up developers.

?And a small number of apps still account for a disproportionate share of overall usage. In November, just seven apps grabbed 10 percent of all sales for the App Store for the iPhone. That number was down from January when 11 apps took in those 10 percent of sales. And just 31 apps generated 10 percent of all free apps downloaded,? Distimo released Thursday.

I've had sinus & allergy problems all my life; my doc 1ce told me sinus problems are common in this part of Louisiana. I've moved to Vermont a couple months ago & my sinus problems got a lot better there. I came back down to spend the holidays with my family & my sinus problems are coming back with a vengeance; I think I must of built up some kind of tolerance & I lost that by being gone for a while. My sinuses have gradually been getting worse sense I've been back. My nose is running aLOT, I'm sneezing some, my eyes are getting watery & itchy at times, I had a sinus headache for a bit yesterday with sinus pressure, I also started occasionally coughing, spitting up a little stuff & feeling a little itchy. I started taking Allegra. It helps some but the improvement only last for like 8 hours instead of lasting for 24 like it's supposed to & the amount of improvement for those 8 hours isn't huge. My doc gave me some samples of Zyrtec a few months ago when I was seeing him for something else & Zyrtec didn't help me a lot either. I've been on various other over the counter & also prescription sinus & allergy meds in the past. I don't remember getting a lot of improvement from any 2nd generation antihistamines; I don't think they are powerful enough for me. Benadryl makes me a little hyper & I don't think I get a great improvement with that either. The only meds I know that have helped me a lot were oral prescription steroid things. I'll be heading back to Vermont in another week so I think I should try another med to hold me over till then. Could anyone suggest something that isn't a 2nd generation antihistamine; perhaps a 1st gen one or an oral steroid(if there's anything like that available without a prescription) or something else Question

If you don't mind putting down your driver's license, you can get straight pseudoephedrine (or combined with loratadine/alegra) from the pharmacist, w/o a prescription; that will dry out your sinuses, but not help with the itchiness.

If you don't mind seeing a doc, try to get a referral to a rheumatologist; they might be able to get you something stronger/more focused on what your body is doing.

Notre Dame football: Contact no problem for Daniels

SOUTH BEND - There was a flash of fear as DaVaris Daniels ran a pass pattern through the middle of the Notre Dame defense Friday, followed by a predictable thump that reverberated throughout his body.

But once the Irish sophomore wide receiver picked himself up after being tackled for the first time in 48 days, he was awash in normalcy.


?It was almost like a confidence boost,? he said Saturday.


And, perhaps a big boost for the Notre Dame offense heading into the BCS National Championship Game between the top-ranked Irish (12-0) and second-ranked Alabama (12-1), Jan. 7 in Miami Gardens, Fla.


The 6-foot-2, 190-pound sophomore finished the regular season as ND?s fourth-leading receiver (25 receptions for 375 yards), despite missing the final 2? games with a broken collarbone suffered at Boston College on Nov. 10.


More telling than those numbers is how he stretches opposing defenses, as his 15-yards-per-catch average ? best among ND?s top five pass catchers ? suggests.


?We?ve got to get big-chunk plays,? Irish head coach Brian Kelly said. ?I?m telling you that right now. They (Alabama) know that. We know that.?


And Daniels knows that.


He also knows that if ND were playing in just about any other postseason game, he?d been questionable at best, if not completely unavailable. The Irish, for instance, played their bowl game on Dec. 29 last season. Daniels? first day of contact practice since the injury was Dec. 28.


?When I broke (the collarbone), I didn?t even know what I had done,? he said. ?I just knew it was bad. It was difficult, because I didn?t know at first if I?d be able to come back. I was just hoping I?d be in this position.?


He?ll be welcomed back into action by a team that ranks first nationally in total defense and second only to the Irish in scoring D.


?We would not put him out there unless he was free from injury,? Kelly said. ?Now he practiced the last three weeks, but in a red jersey. We just didn?t want any contact. I usually don?t put jerseys on guys, but I wanted him?to be involved in all the timing work, but nobody could touch him.


?Now, he?s out of the red jersey. He?s good to go out and play, jump, get hit, fall down. He?s a really good player who understands his reps are going to be based upon how he practices and how he performs. I?m certain that he?ll play a role in the game.?


Personnel matters


Safety Austin Collinsworth was never expected to be a late-season option to play for the Irish, but Kelly at least figured he?s have the junior available for scout-team duty in preparation for Alabama.

But as Collinsworth recovered from June shoulder surgery that effectively wiped out his 2012 season, he began to experience back discomfort.


The day before the Irish closed the regular season Nov. 24 at USC, Collinsworth underwent back surgery, Kelly revealed Saturday.


?It?s similar to what (tight end Tyler) Eifert had,? Kelly said. ?He needed that attended to. He feels great, so we think we?ve got him put back together, and he?s champing at the bit.?


Collinsworth, a possible starter for 2013 who will potentially have two seasons of eligibility left, is expected to be full-go in the spring, per Kelly.

Federal Housing Finance Agency Reports Mortgage Interest Rates ...

Washington, DC ? December 27, 2012 ? (RealEstateRama) ? The Federal Housing Finance Agency (FHFA) today reported that the National Average Contract Mortgage Rate for the Purchase of Previously Occupied Homes by Combined Lenders, used as an index in some adjustable-rate mortgage (ARM) contracts, was 3.36 percent based on loans closed in November. There was a decrease of 0.08 from the previous month. With data for February 2012, FHFA began calculating interest rates using un-weighted survey data. The complete contract rate series can be found at http://www.fhfa.gov/Default.aspx?Page=251.

The average interest rate on conventional, 30-year, fixed-rate mortgage loans of $417,000 or less decreased 4 basis points to 3.54 in November. These rates are calculated from the FHFA?s Monthly Interest Rate Survey of purchase-money mortgages (see technical note). These results reflect loans closed during the November 26 ? 30 period. Typically, the interest rate is determined 30 to 45 days before the loan is closed. Thus, the reported rates depict market conditions prevailing in mid- to late-October.

The contract rate on the composite of all mortgage loans (fixed- and adjustable-rate) was 3.36 percent in November, down 8 basis points from 3.44 percent in October. The effective interest rate, which reflects the amortization of initial fees and charges, was 3.49 percent in November, down 8 basis points from 3.57 percent in October.

This report contains no data on adjustable-rate mortgages due to insufficient sample size. Initial fees and charges were 1.08 percent of the loan balance in November, up 3 basis points from October. Sixteen percent of the purchase-money mortgage loans originated in November were ?no-point? mortgages, down from 21 percent from the share in October. The average term was 27.4 years in November, down 0.1 years from October. The average loan-to-price ratio in November was 75.7 percent, down 0.1 percent from 75.8 percent in October. The average loan amount was $272,300 in November up $14,900 from $257,400 in October.

Week 25: Baby's First Christmas

How was everyone?s Christmas?!

We had a wonderful time celebrating with family. I?m so thankful to be with them for Christmas this year. Hunter had a pretty great Christmas too! He was fed some delicious eats and scored some awesome gifts. He?s a spoiled little guy already!

How far along? 25 weeks

Baby?s size? The size of a cauliflower! He measures about 13.6 to 14.8 inches long and weighs about 1.5 to 2.5 pounds.

Total weight gain/loss: Not sure? Haven?t weighed myself this week.

Stretch marks? Nope.

Sleep: This past weekend wasn?t the best in the sleeping department, but I think it was because of the bed I was sleeping on if anything. The last few nights have been much better though!

Best moment this week: Our first baby shower! I can?t wait to tell you all about it!

Miss Anything? Lox and bagels (raw salmon, cream cheese, capers, & onion on a bagel) on Christmas morning. Love those things?

Movement: Oh yes! Lots of movement. It?s been so fun to see the reactions of several of my family members when they feel him move for the first time.

Food cravings: I?ve noticed that my love for salt continues, as well as carb-y foods (i.e. bread, pretzels, crackers, etc).

Anything making you queasy or sick: Nope! Yay!

Gender: BOY!

Labor Signs: None

Symptoms: My hunger has been out of control this past week! I swear my belly grew quite a bit too, so I?m thinking Baby Hunter went through a little growth spurt.

Belly Button in or out? It?s pretty much an outie these days! You can see it poking through some of my tighter fitting tops.

Wedding rings on or off? On, but I have noticed a little bit of swelling in my hands and feet this past week. We?ll see how much longer the rings stay on!

Happy or moody most of the time: Happy! It helps that I?m with all my family. Can?t beat that!

Looking forward to: Our second baby shower on Saturday!

I have lots of family to hang out with, so I?m going to keep things pretty simple today and leave you with that. I hope you all are enjoying your Christmas week!

The prognosis for Africa?s projected economic growth is positive, as commonly reported in the media.

At a time when western economies are faltering, the positive statistics make particularly attractive reading, says Florence Menson, JHI Ghana?s centre manager of Marina Mall in Accra, the capital city of Ghana.?

?International investors persuaded of the merits of Africa investment will still be careful to minimise their risks, which leads us to Ghana.?

Menson explains that the death of President John Atta Mills in July 2012 was mentioned in news bulletins around the world but did not become a cause for political unease.?

That it didn?t should be seen as a fitting tribute to him.?

Power passed to John Dramani Mahama without fuss and was seen as another positive indicator of Ghana?s stability, she says.

In 2011, Ghana was at the top of the world economic growth charts with a whopping 14.4 percent, boosted by new oil production and helped by the construction sector.?

Those dizzy heights of double-digit growth may be a one-off, with oil production reaching a plateau in 2012, but Ghana is expected to still achieve around 7.5 percent in 2012 and again in 2013.

Ghana?s middle-income status and oil receipts have provided the country with the fiscal space to seek non-concessional sources of finance.?

In August 2011, the Ghanaian parliament approved a USD3 billion loan from the China Development Bank.?

This facility is the largest ever secured by Ghana and will be used to finance its infrastructure gap.?

?This influx of funding will need to be spent wisely and governed by a framework.?

?And while foreign investment is increasing to record highs, there are, however, bumps in the road ahead,? she points out.

The sale of Actis?s 85 percent stake in Accra Mall to a consortium of South African investors including Sanlam and Atterbury is welcome news and underlines Ghana?s position as an investment destination for global investors seeking diversification in their real estate portfolios, he says.

That drop has made imports more expensive and inflation has risen to around 10 percent.?

Ghana?s current account deficit is widening due to higher import growth and a large increase in profit repatriation by extractive industries.?

Investors have been moving their funds out of the country amid short-term uncertainties linked to the election cycle, she says.

Current retail real estate environment

William Bobie, executive director, Assenta Real Estate Investment Managers says according to a World Bank classification, on 1 July 2011 Ghana moved from a low-income to lower middle-income status.?

A gross national income of $1 571 was achieved in 2011, up 44 percent from 2009 levels per a Ghana Statistical survey.

?The new phenomenon of a middle class, plus the country?s reputation for political and economic stability and cultural tolerance has rapidly revolutionised the retail property market in recent years.

?Dedicated modern retail malls still account for a relatively small proportion of the retail market.??

Bobie says Accra, the country?s capital, is the main retail hub for international retailers and home to the modern shopping malls in operation offering diverse and buoyant informal retail landscape.

He says A&C Square in 2005, followed by Accra Mall in 2007, set the pace for modern retailing.?

A&C Square in the East Legon area of Accra is largely a neighbourhood centre with a recent addition of substantial office space.?

Accra Mall changed the face of retail considerably with 21?000 square metre of lettable area, anchored by Shoprite and Game.

?The success of A&C Square in East Legon has confirmed the need for neighbourhood retail centres in Accra.

Melcom and Maxmart, local general merchant retail stores, have capitalised on this emerging demand by opening stores in almost all the major areas of Accra.?

Koala, a local grocery retailer, has also responded to this trend by recently opening another shop in the Airport Residential Area to add to its flagship outlet in Osu.

On a regional level, Kumasi and Takoradi, the next two most populous cities in Ghana, have no formal retail centres even though the fundamentals look right.?

There is a huge opportunity for first time movers to develop shopping centres in these regions, says Bobie.

Space supply and development

With Accra Mall and A&C being the only formal retail centres available in the market, occupancy rates are near 100 percent.?

Movenpick Hotel?s 2 000 square metre retail space offering 26 shop units is also fully occupied by a variety of boutique shops while Shoprite?s solus unit on the western corridor of Accra is also self-occupied with no available space to let.

??Although there is a high demand for retail space from both foreign and local occupiers, supply of space has been sluggish,? says Bobie.

With a growing population of 2.5 million plus in Accra, the city has capacity for more retail centres to augment the current 30?000 square metre of formal retail space.

Since the completion of Accra Mall in 2007, surprisingly no formal retail shopping mall has been built.

However, a number of small to medium schemes are under construction in Accra, including retail and office developments of Marina Mall, Nester Square, One Airport Square and Icon House in the Airport area, The Octagon in Ridge plus the Oxford Street Mall and hotel development in Oxford Street, in Osu.

Menson says notable inclusions are Oxford Street Mall and Marina Mall, which are both expected to complete in the coming months, and One Airport Square, an ambitious green star compliant project that will set the bar for environmental standards.

In addition, numerous pipeline projects are in the planning stages.? These include some sizeable developments: West Hills, Project Sunrise and Gold Coast City in Accra, Apolonia in Tema, King City in Takoradi (all mixed-use developments), Accra Mall extension retail development in Accra, and various developments in Kumasi.

West Hills Mall, if completed by 2014 is anticipated to be the largest purpose built mall in Accra offering about 26?000 square metres.

Bobie says the retail occupier market has transformed in the last seven years with the entry of international retailers such as Shoprite, Game, Bata, Hi-sense, Mr Price, Woolworths, TM Lewin, and Stellar Deluxe, while KFC and Deli France are recent new additions to enter the Ghanaian market.

?South African retailers currently dominate the international retailers but there are clear signs that European and American retailers are also eyeing the market and with the right space we believe the market will become competitive and diverse in the very near future,? says Bobie.

He says the strong demand for retail space is impacting positively on retail rentals.?

Using Accra Mall as the benchmark in 2007, retail rents have seen phenomenal growth from $20 per square metre per month to current levels in new developments of above $45 per square metre.

The retail property investment market is still at its infancy stage.?

Future prospects

Menson says Ghana has a relatively open society, with a media and a public debate that is able to openly challenge politicians.?

There are more than 100 private radio stations and over 20 privately-owned newspapers in Ghana.?

The Freedom of Information Bill is slowly winding its way through parliament and this is perhaps where Ghana can distinguish itself from some of the other African economies that boomed over the past 20 years or so, including many which did so on the back of oil wealth, but were unable to sustain their development because their democratic foundations were not solid.

Ghana measures up well to its African counterparts in terms of civil liberty, political rights, and ease of doing business.

The country is not without issues but since 2000 there have been two successful transfers of power and the 1994/95 land disputes in the north appear a long way in history.

??Barack Obama once hailed Ghana as a ?model for democracy and this will be put to the test in December this 2012 when elections take place.?

? Most Ghanaians believe that democracy is well-entrenched and security and peace will prevail.

?If this is so then Ghana appears set to benefit from increased investment in its real estate and remain near the top of the shopping list for investors in Africa, she adds.

Nervous retailers hope for post-Christmas rush

The biggest holiday of the season is over, but retailers are hoping that you aren?t done with your holiday shopping quite yet.

?The next few days are critical for retailers. They?ve got some catching up to do,? said Marshal Cohen, retail industry analyst with NPD Group.

On Wednesday, big chains including Macy's were already pushing their post-Christmas bargains, while major discounters?including Wal-Mart were encouraging shoppers to redeem their gift cards right away. But the fallout from a big Christmas storm could hurt their efforts if shoppers decide they prefer a cozy rest of the week at home instead.

Retailers had started off the all-important holiday shopping season in a much cheerier mood, as Black Friday shoppers appeared to gobble down turkey and rush to the stores ? and their computers ? in search of holiday gifts and bargains.

But then, a combination of factors including Superstorm?Sandy and the political upheaval over the fiscal cliff appeared to dim shoppers? moods. Experts also?said the stronger start to the season may have been a sign that people finished up early and had fewer last-minute shopping trips to make.

?The early start certainly looked like it meant that the consumer was in full spirits,? Cohen said. ?But in reality just because they had a front-loaded holiday didn?t mean there was going to be that much more spending to come.?

It's too early to paint a complete picture of how retailers fared so far in the most crucial season of the year. But early indications have some fretting that the year will end up being weaker than many had initially hoped.

Holiday-related sales rose 0.7 percent from Oct. 28 through Dec. 24, as compared to last year, according to data from Mastercard Advisors SpendingPulse. That was the lowest growth rate for that period?since 2008, at the depths of the recession. The same?survey showed a 2 percent increase in 2011.

The SpendingPulse data is based on estimates of payments made through the MasterCard network as well as by cash and check. It tracks holiday-related purchases including apparel, electronics and jewelry.

Research firm ShopperTrak, which compiles sales estimates based on foot traffic, said last week that it expects holiday sales to increase by 2.5 percent. That?s down from?its previous estimate that sales would increase by 3.3 percent.

But other researchers have not changed their initial forecasts for the season.

On Wednesday, the International Council of Shopping Centers, which produces an index of chain store sales along with Goldman Sachs, said it was holding to its estimate that holiday sales at chain stores would rise 3 percent this year.

?The ICSC?s chief economist, Michael Niemira, said in a note that sales in the last week of December could benefit from a calendar shift that put Christmas Eve on Monday this year.

A National Retail Federation spokeswoman said in an e-mail Wednesday that it also was sticking with its forecast that holiday sales would grow 4.1 percent to $586.1 billion.

Experts caution that it?s hard to say just yet what the final data will show, especially once post-holiday bargains are factored in.

?There?s no question that we saw a lot of (the) momentum slow down. How much did it slow down? We don?t really know yet,? Cohen said.

Holiday sales are considered crucial to retailers, and some can expect to make as much as half their profits, and 30 percent of their sales, during the two-month period.

The fiscal cliff, Superstorm?Sandy and other external factors are partly to blame for souring shoppers? moods toward the end of the season. But experts say shoppers have in recent years also become more savvy about sussing out bargains.

They?ve also become more bargain-conscious. C. Britt Beemer, retail analyst with America?s Research Group, said in a research note that major discounters appeared to fare best in keeping their customers.

?Consumers were very frugal this year, as we said all along,? Beemer said in the note.

The increasing shift to online shopping also may not be helping retailers pick up any extra sales. That?s because when a person shops online, they tend to seek out the best bargain and then buy that item. An in-store shopper may be more tempted to walk the other aisles, pick up a few things for themselves or do some other impulse shopping they hadn?t planned on.

?The consumer didn?t spend a lot of time this year buying those extra gifts. They didn?t spend a lot of time spending on themselves instead of others,? Cohen said.

(AP) ? Defying a storm of domestic and international criticism, Russia moved toward finalizing a ban on Americans adopting Russian children, as Parliament's upper house voted unanimously Wednesday in favor of a measure that President Vladimir Putin has indicated he will sign into law.

The bill is widely seen as the Kremlin's retaliation against an American law that calls for sanctions against Russians deemed to be human rights violators. It comes as Putin takes an increasingly confrontational attitude toward the West, brushing aside concerns about a crackdown on dissent and democratic freedoms.

Dozens of Russian children close to being adopted by American families now will almost certainly be blocked from leaving the country. The law also cuts off the main international adoption route for Russian children stuck in often dismal orphanages: Tens of thousands of Russian youngsters have been adopted in the U.S. in the past 20 years. There are about 740,000 children without parental care in Russia, according to UNICEF.

All 143 members of the Federation Council present voted to support the bill, which has sparked criticism from both the U.S. and Russian officials, activists and artists, who say it victimizes children by depriving them of the chance to escape the squalor of orphanage life. The vote comes days after Parliament's lower house overwhelmingly approved the ban.

The U.S. State Department said Wednesday it regretted the Russian parliament's decision.

"Since 1992, American families have welcomed more than 60,000 Russian children into their homes, providing them with an opportunity to grow up in a family environment," spokesman Patrick Ventrell said in a statement from Washington. "The bill passed by Russia's parliament would prevent many children from enjoying this opportunity ...

"It is misguided to link the fate of children to unrelated political considerations," he said.

Seven people with posters protesting the bill were detained outside the Council before Wednesday's vote. "Children get frozen in the Cold War," one poster read. Some 60 people rallied in St. Petersburg, Russia's second largest city.

The bill is part of larger legislation by Putin-allied lawmakers retaliating against a recently signed U.S. law that calls for sanctions against Russians deemed to be human rights violators. Although Putin has not explicitly committed to signing the bill, he strongly defended it in a press conference last week as "a sufficient response" to the new U.S. law.

Originally Russia's lawmakers cobbled together a more or less a tit-for-tat response to the U.S. law, providing for travel sanctions and the seizure of financial assets in Russia of Americans determined to have violated the rights of Russians.

But it was expanded to include the adoption measure and call for a ban on any organizations that are engaged in political activities if they receive funding from U.S. citizens or are determined to be a threat to Russia's interests.

Russian children's rights ombudsman Pavel Astakhov told the Interfax news agency that 46 children who were on the verge of being adopted by Americans would stay in Russia if the bill is approved ? despite court rulings in some of these cases authorizing the adoptions.

The ombudsman supported the bill, saying that foreign adoptions discourage Russians from adopting children. "A foreigner who has paid for an adoption always gets a priority compared to potential Russian adoptive parents," Astakhov was quoted as saying. "A great country like Russia cannot sell its children."

Russian law allows foreigners to adopt only if a Russian family has not expressed interest in a child being considered for adoption.

Some top government officials, including the foreign minister, have spoken flatly against the adoption law, arguing that the measure would be in violation of Russia's constitution and international obligations.

But Senator Mikhail Margelov, chairman of the Council's foreign affairs committee, referred to the bill as "a natural and a long overdue response" to the U.S. legislation. "Children must be placed in Russian families, and this is a cornerstone issue for us," he said.

Margelov said that a bilateral Russian-U.S. agreement binds Russia to give notice of a halt to adoptions 12 months in advance. Putin spokesman Dmitry Peskov told Russian news agencies that the president would consider the bill within the next two weeks.

The measure has become one of the most debated topics in Russia.

By Tuesday, more than 100,000 Russians had signed an online petition urging the Kremlin to scrap the bill.

Over the weekend, dozens of Muscovites placed toys and lit candles in front of the Duma, Russia's lower house of parliament after it approved the bill on Friday, but security guards promptly removed them. Opposition groups said they will rally against the bill on Jan. 13, and several popular artists publicly voiced their concern about the legislation.

While receiving a state award from Putin on Wednesday, film actor Konstantin Khabensky wore a badge saying "Children Are Beyond Politics." Veteran rock musician Andrey Makarevich called on Putin Monday to stop "killing children."

During a marathon Putin press conference Thursday, eight of the 60 questions the president answered focused on the bill. Responding angrily, Putin claimed that Americans routinely mistreat children from Russia.

The bill is named in honor of Dima Yakovlev, a Russian toddler who was adopted by Americans and then died in 2008 after his father left him in a car in broiling heat for hours. The father was found not guilty of involuntary manslaughter. A Russian television report showed Yakovlev's blind grandmother who claimed that the U.S. family that adopted her grandson forged her signature on documents allowing them to take the boy outside Russia.

Russian lawmakers argue that by banning adoptions to the U.S. they would be protecting children and encouraging adoptions inside Russia.

In a measure of the virulent anti-U.S. sentiment that has gripped parts of Russian society, a few lawmakers went even further, claiming that some Russian children were adopted by Americans only to be used for organ transplants and become sex toys or cannon fodder for the U.S. Army.

Americans involved in adoption of Russian children find the new legislation upsetting.

Bill Blacquiere, president of New York City-based Bethany Christian Services, one of the largest adoption agencies in the U.S., said he hopes Putin won't sign the bill.

"It would be very sad for kids to grow up in orphanages," Blacquiere said. "And would hurt them socially, psychologically and mentally. We all know that caring for children in institutions is just not a very good thing."

Joyce Sterkel, who runs a Montana ranch for troubled children adopted abroad and has adopted three Russian children herself, said she is concerned for the estimated 700,000 children who live in state-run institutions in Russia.

"I would prefer that the Russians take care of their own children. I would prefer that people in the United States take care of their own children," Sterkel said Wednesday. "But if a suitable home cannot be found in that country, it seems reasonable that a child should be able to find a home outside."
